Understanding Laws and Rules

The Health Care Authority (HCA) and its programs - Basic Health, Community Health Services, and Public Employees Benefits Board (PEBB) - are governed by laws passed by the Washington State Legislature and codified in the Revised Code of Washington (RCW), and by rules adopted by the HCA and codified in the Washington Administrative Code (WAC). The rules adopted by the HCA add details to the laws passed by the Legislature. These laws and rules are published annually by the Office of the Code Reviser.

The rule-making process allows the public to comment on proposed rules prior to their adoption.

  • Preproposal of rules provides notice that the HCA may consider adopting rules on a topic, and is published on form CR-101.
  • Notice of proposed rulemaking provides the proposed rules, information on how to comment on the proposed rules, and the deadline for comments, on form CR-102.
  • Notice of adoption of a rule provides the rule as adopted, as well as its effective date, on form CR-103.
